5. Title: Order amending the Order of 7 October 2023 on the methodology for calculating the environmental score and the minimum score value to be achieved for eligibility for the environmental bonus for new electric passenger cars
6. Product/service details: New electric passenger cars
7. Notification under another EU law:
8. Executive summary: The amending order revises, with effect from 24 October 2026, the methodology for calculating the environmental score of new electric passenger cars, by introducing a third vehicle category.
9. Brief statement of grounds: The Order of 7 October 2023, concerning the methodology for calculating the environmental score and the minimum score to be achieved, distinguishes—in its Article 3—between two categories of new electric passenger cars, with a different calculation method for each. The threshold separating these two categories is based on three technical criteria (electric range, boot capacity and number of seats), which have been selected to reflect the variety of ways in which vehicles are used. The method used to convert the carbon footprint into a final score varies according to the vehicle category, which makes it possible to take into account this variety of use cases, to assess vehicles in comparable segments and with comparable uses, and thus to recognise a vehicle’s environmental performance within its category.
The draft amending order expands on this distinction by creating, on the basis of the aforementioned criteria (range, boot capacity, number of seats), a third category of electric vehicles. This proposal addresses two key observations: firstly, a very large proportion of electric vehicles that meet the minimum score currently fall into the second category; secondly, the current division into two categories does not adequately reflect the variety of use cases – ranging from small city cars for personal use to larger vehicles intended primarily for family or commercial use. Maintaining a distinction between the new categories 2 and 3, whilst not relaxing the environmental requirements for the score, therefore requires a modification to the method used to calculate the score for category 2 vehicles.
A transitional clause relating to the new eligibility provisions for the environmental score has been included, notably to ensure legal certainty for commercial commitments already entered into.
9a. Appropriateness of the measure taken to achieve the objective pursued: This policy measure aims to ensure that subsidies for the purchase of new electric passenger cars and certain tax provisions are given priority for electric cars achieving the minimum environmental score, i.e. the most environmentally sound, in accordance with national and European objectives for decarbonising and reducing the environmental footprint of the vehicle fleet. Regularly updating the list of Types, Variants and Versions (TVV) that meet the minimum environmental score ensures the effectiveness of the system by taking into account the continuous evolution of manufacturers' offerings. The system is based on an objective and transparent methodology, applied consistently to all vehicles concerned.
9b. Necessity: The measure does not introduce a prohibition on placing new electric passenger cars on the market or restrict their circulation, but only conditions eligibility for certain public subsidies and adjusts the assessment of certain tax provisions. Updating the list of TVVs that meet the minimum environmental score, established by the Order of 14 December 2023, through an amending order, constitutes the least restrictive measure for ensuring a uniform, transparent and objective application of this system.
9c. Excessive burden in relation to the objective pursued: The effects of the environmental score on the internal market remain limited and proportionate, since this system does not restrict the marketing or import of the vehicles concerned, but only regulates access to certain subsidies for the purchase of new electric cars and the assessment of certain tax provisions. The requirements applied are based on objective and non-discriminatory criteria, identical for all manufacturers. In light of the national and European objectives for reducing carbon footprints, the expected environmental benefits outweigh the limited administrative burdens imposed by the system.
