5. Draft Regulation of the Minister for Infrastructure on the approval of individual vehicles

8. The draft Regulation on the approval of individual vehicles contains provisions of the nature described below:
(1) technical:
(a) the scope of the conditions and technical requirements applicable to the national individual vehicle approval procedure, taking into account equivalent alternative requirements,
(b) the scope and method of carrying out the national individual vehicle approval tests,
(2) procedural:
(a) model documents relating to the national and EU procedures for the approval of individual vehicles:
– model application for an EU or national individual vehicle approval certificate,
– model of an EU or national individual vehicle approval certificate,
– model of the declaration containing the vehicle data and information necessary for the registration and recording of the vehicle,
(b) rules of conduct of the Director of Transport Technical Inspection (TDT) and technical services in relation to activities carried out for the purpose of individual vehicle approval:
– the rules for the assignment of numbers to certificates of approval,
– the method by which the service carries out the examinations for the purpose of the admission,
– the procedure to be followed by the Director of the TDT in relation to the application for a certificate.
Thanks to the above-mentioned requirements, procedures and model documents, it will be possible to obtain individual certificates of approval for new vehicles in Poland.

The draft Regulation on individual vehicle approval implements the delegation contained in Article 68(1) of the Act of 14 April 2023 on systems for the approval of vehicles and their equipment (Journal of Laws item 919), which organises matters relating to the type approval of vehicles, equipment or parts by aligning national legislation with the requirements contained in international regulations such as:
1. Regulation (EU) No 167/2013 of 5 February 2013 on the approval and market surveillance of agricultural and forestry vehicles
2. Regulation (EU) No 168/2013 of 15 January 2013 on the approval and market surveillance of two- or three-wheel vehicles and quadricycles;
3. Regulation (EU) No 2018/858 of 30 May 2018 on the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles, amending Regulations (EC) No 715/2007 and (EC) No 595/2009 and repealing Directive 2007/46/EC;
4. Revision 3 of the Agreement concerning the adoption of harmonised UN technical regulations concerning the complete vehicle approval of passenger cars and the approval of vehicle equipment and components.
In view of the adoption of the above-mentioned Act and the delegation established therein, it was necessary to regulate, by means of a Regulation of the Minister for Infrastructure, the provisions applicable in the area of the national individual vehicle approval procedure, which is an alternative procedure to the vehicle type approval procedure.
