5. Amendment to Regulation No. 95 of the Minister for Agriculture of 6 November 2014 on composition and quality requirements for jam, jellies, marmalade and sweetened chestnut purée and requirements for the provision of food information

6. The requirements for jam, jelly, marmalade and fruit jelly are specified.

The draft regulation increases the minimum fruit content for certain products, allows for the option to not add sweeteners to products with reduced sugar content and clarifies labelling details, such as waiving the requirement to indicate the sugar content in the same visual field as the name of the product. In addition, it clarifies the use of the notion 'marmalade' for a product made from citrus fruits and other fruits, deletes the provisions on the treatment of raw materials with sulphur dioxide and sulphites and the inclusion of sulphur dioxide in the list of ingredients. It is specified that the juice used as an optional ingredient in the preparation of jams and jellies may be either concentrated or unconcentrated. For the product name ‘jam’, introduced as a national requirement, the lower limit for the fruit content will be increased and the upper limit for the soluble solids content will be more clearly defined at 59 %.
The draft regulation will enter into force on 14 June 2026. Products placed on the market or labelled before 14 June 2026 and in accordance with the requirements in force before that date may be marketed until stocks are exhausted. The product name ‘jam’ will be subject to the increased fruit content requirements from 1 January 2027 and the jams placed on the market before that date can be sold until the end of their life.

The Regulation transposes the requirements laid down in Directive (EU) 2024/1438 of the European Parliament and of the Council amending Council Directive 2001/113/EC relating to fruit jams, jellies and marmalades and sweetened chestnut purée intended for human consumption. In addition to the transposition of European Union law, the requirements for the composition of the product name ‘jam’, established as a national requirement, are specified.
