5. Draft Order of the Government of the French Community on the protection of minors from television programmes that may harm their physical, mental or moral development.
6. Non-linear television services (on-demand audiovisual media services within the meaning of the Audiovisual Media Services Directive (AVMSD) 2010/13/EU) insofar as they constitute information society services.

The draft aims to introduce rules to protect minors from television programmes that may harm their physical, mental or moral development pursuant to the provisions set out in Article 2.5-1(1) of the Decree of 4 February 2021 on audiovisual media services and video-sharing services (Audiovisual Media Services Decree). Article 2.5-1(1) of the Audiovisual Media Services Decree transposes Article 6a of the AVMSD 2010/13/EU.
In the case of non-linear television services, this involves requiring the following for such services:
- the implementation of a protection system based on the introduction of a parental access code;
- the insertion of visual symbols (indicating an age category and the nature of the content) in the electronic programme guide in order to alert the viewer to the potential harm the programme may cause to minors.

The AVMSD 2010/13/EU, amended in 2018, now requires all Member States to implement a system of content descriptors (see Article 6a of the Directive) intended to inform viewers about the type of content that is harmful to minors. This system has been transposed into Article 2.5-1(1) of the Decree of 4 February 2021 on audiovisual media services and video-sharing services (Audiovisual Media Services Decree) and therefore specifies that the visual symbol intended to warn of the potentially harmful nature of a programme must provide information on the potentially harmful nature of the content of that programme.
It is therefore necessary to revise the Decree of the Government of the French Community of 21 February 2013 on the protection of minors against television programmes likely to harm their physical, mental or moral development, which provides for a programme symbol that does not currently give any indication of the type of harmful content.
The French Community of Belgium, when drawing up the symbols for television programmes, had chosen to adopt a system based solely on recommendation pictograms by age category (all audiences, 10, 12, 16, 18). Therefore, in order to comply with the new AVMSD and Article 2.5-1(1) of the Audiovisual Media Services Decree transposing it, it is necessary to impose content indicators/descriptors (violence, sex, distress, etc.).
