5. Draft Act amending the Act of 21 December 1998 on product standards to promote sustainable production and consumption patterns and to protect the environment, public health and employees, in order to introduce a ban on the use of oxo-degradable plastic products and certain other single-use plastic products
6. This draft is intended to immediately transpose into Belgian law certain provisions of a European directive introducing
a ban on the use of oxo-degradable plastics (that can be broken down chemically or that can break down into small plastic particles)
as well as on certain other single-use plastic products.
In addition to the prohibitive provisions introduced in said directive,
this draft also introduces a ban on the use of single-use plastic bags.
7. - Directive 94/62/EC on packaging and packaging waste
- (Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019 on the reduction
of the impact of certain plastic products on the environment)
8. The draft is intended to amend the Act of 21 December 1998 on product standards to promote sustainable production and consumption patterns and to protect the environment,
public health and employees.
It introduces a ban on placing certain products onto the market. To this end, it adds several definitions to the Act of 21 December 1998 (Article 2 of the draft) and inserts a new Chapter IVbis ‘Special provisions on single-use plastic products’ (Article 3).
More specifically, the ban on placement onto the market covers products based on oxo-degradable plastic (Article 4), certain single-use plastic products (Article 5)
and certain single-use carrier bags designed for packing or carrying goods purchased at indoor or outdoor points-of-sale.

This draft is intended to immediately transpose into Belgian law Article 5 of Directive 2019/904, with addition of a ban on the marketing of single-use plastic bags.According to the submitting party, the marketing of said plastic bags must be banned in any case because they are incompatible with a healthy environment: after all, these bags, which take hardly one second to produce, are used for 20 minutes on average, but have a lifespan ranging from one to four centuries. Moreover, these bags pose a serious threat to biodiversity because birds and marine animals swallow them. Bans of this kind are in force not only in France, Spain and Italy, but also elsewhere in the world. For instance, no less than 25 African countries have banned the use of single-use plastic bags.
