8. The draft text contains provisions related to the remuneration of health professionals for screening of SARS-CoV-2 variants using a specific RT-PCR technique following a positive antigen test and the corresponding samples.

End of exemptions allowing the use of digital tools that do not comply with the general health information system security policy and the regulations on the hosting of telehealth health data.

End of the exemptions concerning the inclusion criteria for telemonitoring experiments implemented on the basis of Article 54 of Law No. 2017-1836 on the financing of social security for 2018 since they are now taken up by a decree of 23 December 2020.

Allow medical biology laboratories to make their own tests detecting infection by variants.

9. On 30 January 2020, the World Health Organization (WHO) declared that the emergence of a novel coronavirus (COVID-19) was a global public health emergency.

In France, the decree of 14 October 2020 declared a state of health emergency throughout the country from 17 October 2020, and two laws extended the state of emergency until 1 June 2021.

In order to facilitate telehealth care of patients infected or suspected to be infected with covid-19, exempting provisions had been provided for the time required for health professionals to equip themselves with digital tools that comply with the general health information system security policy and the regulations on the hosting of health data. It is now necessary to end these temporary exemptions.

The exceptions to the inclusion criteria for telemonitoring experiments implemented on the basis of Article 54 of the Social Security Financing Act of 2018 are now provided for by the above-mentioned Decree of 23 December 2020, and they are no longer included in that of 10 July 2020.

Knowledge of the level of presence and dissemination of the various variants on the national territory is necessary for the proper management of the epidemic crisis, thus allowing greater fluidity and better responsiveness for the use of devices detecting new variants by allowing medical biology laboratories to manufacture for their own use in vitro diagnostic medical devices used for the production of a screening of variants of SARS-CoV-2 using a specific RT-PCR technique.

It is necessary to allow the screening to detect the presence of different variants of interest circulating in the territory following an antigenic test with a positive result and to provide for the remuneration of corresponding sampling and screening actions for the different health professionals.
