5. Ordinance of the Federal Minister for Social Affairs, Health, Care and Consumer Protection on the mandatory disclosure of information on the provenance of meat, milk and eggs along the supply chain of food business operators

Based on Article 8(8) of Regulation (EU) No 1169/2011 on the provision of food information to consumers, OJ L 304 of 22 November 2011, p. 18, last amended by OJ L 327 of 11 December 2015, p. 1, this Ordinance specifies the disclosure of information on the provenance of meat, milk and eggs in commercial documents along the food chain.

The main purpose of this Ordinance is to further detail the disclosure of information along the food chain provided for in Article 8(8) of Regulation (EU) No 1169/2011 on food information to consumers, to facilitate the disclosure of information on the provenance of meat, milk and eggs along the supply chain of food business operators. This addresses Austrian food business operators.
The method in which disclosing information on meat from sheep, goats, swine and poultry intended for further processing is communicated is based on the provisions of Commission Implementing Regulation (EU) No 1337/2013 as regards the indication of the country of origin or place of provenance for fresh, chilled and frozen meat of swine, sheep, goats and poultry.
Indication of the place where the animal was milked has been selected for the indication of origin of milk because this is the most likely to correspond to the understanding, expectations and interest of consumers regarding indication of provenance.
Indication of the place where an egg was laid is the decisive criterion with respect to consumer perceptions and expectations regarding information on its provenance. The indications of ‘country’, ‘countries’, ‘EU’, ‘non-EU’ or ‘EU and non-EU’ are used in line with the labelling provisions in Article 2 of the Commission Implementing Regulation (EU) 2018/775.

Food business operators that promote the provenance of a food must apply Commission Implementing Regulation (EU) 2018/775 laying down rules for the application of Article 26(3) of Regulation (EU) No 1169/2011 of the European Parliament and of the Council on the provision of food information to consumers, as regards the rules for indicating the country of origin or place of provenance of the primary ingredient of a food. It is sometimes difficult to obtain the necessary information along the supply chain in a way that allows for certainty regarding provenance.
Based on Article 8(8) of Regulation (EU) No 1169/2011 on the provision of food information to consumers, the Ordinance specifies the disclosure of information on the provenance of meat, milk and eggs in commercial documents along the food chain.
