5. Draft Royal Decree regulating the requirements in order to be considered a user of special significance for the purposes of the provisions of Law 13/2022 of 7 July 2022, General Audiovisual Communication.

The draft Royal Decree implements Article 94 of Law 13/2022, of 7 July 2022, General Audiovisual Communication, a standard which in turn transposes into Spanish law Directive (EU) 2018/1808 of the European Parliament and of the Council of 14 November, amending Directive 2010/13/EU on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of audiovisual media services.
This article regulates, among other aspects, the requirements to be considered 'influencers' or 'vloggers', i.e. users of video-sharing services through a platform, capable of mobilising a significant part of the audience, competing with other audiovisual media service providers in the audiovisual advertising market. It is therefore considered appropriate that, when these users meet a series of requirements (audience, revenue, editorial responsibility for content), they would be subject to a series of obligations aimed at protecting viewers in general, and minors in particular, from harmful or damaging content.
The draft Royal Decree specifies the requirements relating to significant revenues and audience established in letters a) and c) of Article 94.2 of Law 13/2022 of 7 July 2022, in order to consider a user of video-sharing services through a platform as a 'user of special significance'.
The draft Royal Decree is composed of a preamble, 4 articles organised in two chapters, and three final provisions.
The complete draft Royal Decree is notified so that the context of the draft Regulation to be notified can be assessed.

Directive 2018/1808 of 14 November 2018 included, under the scope of the Audiovisual Media Services Directive, video-sharing platform services and all social media services where video-sharing constitutes an essential functionality of the service. The inclusion of this type of service was motivated both from an economic point of view, as they are services that compete for advertising revenue with the audiovisual communication services themselves, and by the need to increase the protection of users, and in particular minors, against the exposure of content that is harmful or potentially harmful to them.
Because of their presence and activity in the audiovisual and advertising market, the Directive, as well as Law 13/2022, established a series of obligations for providers of video-sharing platform services in relation to their audiovisual content, audiovisual commercial communications and the protection of their viewers (especially minors).
'Users of special significance' are a special category of users who carry out an economic activity through the production and dissemination of audiovisual content via this type of service, and who have a significant audience within the video-sharing service through the platform, giving them a greater potential to affect their audience, and especially minors.
It is therefore considered necessary to specify the requirements, both in terms of income and audience, that 'users of special significance' must meet in order to be considered as such. Compliance with these requirements will result in the obligation to register in a State Register of Providers, as well as the obligation to comply with the regulations on audiovisual content, audiovisual commercial communications and the protection of minors.
