8. The draft technical regulation provides:
• in Article 1, access to social media services and video-sharing platforms only to persons over 15 years of age, in order to respond to the need to radically mitigate the risks to which children under 15 years of age are exposed, to better protect them in their relationship with the digital environment;
• in Article 2, to refer to social media service providers and audio and video sharing platforms, in the manner that each of them wishes to adopt, the verification of the age of users, in line with the applicable sector-specific regulations and taking into account the future European Digital Identity Wallets (EUDI) as well as the planned adoption of the European Commission guidelines;
• in Articles 3 and 4, to protect minors in the digital environment by raising from 14 to 15 years the minimum age for expressing consent to the processing of personal data and rendering void existing contracts relating to accounts of minors under 15 years of age, which are not adapted, within a reasonable time, to the provisions of this regulation;
• in Article 5, the issuing of guidelines by AgCom to regulate the activity of influencers under the age of 15, in order to ensure transparency, correctness of information and protection of the minors involved, also introducing a system of authorisation and management of the proceeds deriving from this activity for the protection of minors;
• in Article 6, the adoption of a specific decree of the President of the Council of Ministers for the preparation of information campaigns on the conscious use of the Internet and the related risks intended for minors and those who exercise parental responsibility.
9. This parliamentary legislative initiative aims to protect users of social media services under 15 years of age, understood as more vulnerable subjects, in the digital environment.
The above, in order to address the numerous problems that have emerged from the massive online presence of the same and the related, sometimes unpredictable, consequences, through the diversified use of devices (especially smartphones) and platforms, including messaging apps, social networks and streaming services.
