5. Draft directive of the Minister for Economic Development concerning the adoption, pursuant to Article 3(4), of Decree No 93 of 21 April 2017 of the Minister for Economic Development, of technical data sheets for the periodic inspection of in-service measuring instruments used for legal measuring purposes.

6. This Directive shall apply to the periodic inspection of the following measuring instruments:
a) Sheet L: systems for the continuous and dynamic measurement of quantities of liquids other than water mounted on tankers (except liquefied gases and cryogenic liquids);
b) Sheet M: systems for the continuous and dynamic measurement of quantities of liquids other than water that are liquefied gases mounted on tankers (LPG).

8. The Draft Directive consists of 3 articles and 2 annexed data sheets.
Article 1 contains the subject matter and scope of the Directive and specifies the measuring instruments to which it applies.
Article 2 lists the annexes showing the procedures to be followed in the periodic inspection of measuring instruments referred to in Article 1.
Article 3 defines the publication process of the Directive.

The annexes contain the supplementary sheets to those already contained in the above-mentioned Decree 93/2017 (Article 3, paragraph 4 of the above-mentioned Decree No 93 of 21 April 2017, states “Furthermore, in order to standardise the technical procedures to be followed in the inspections throughout the national territory and to better specify the requirements already contained in this Regulation, the Ministry for Economic Development may define specific directives, also with regard to specific technical standards”.):
Annex I:
- Sheet L: systems for the continuous and dynamic measurement of quantities of liquids other than water mounted on tankers (except liquefied gases and cryogenic liquids);
- Sheet M: systems for the continuous and dynamic measurement of quantities of liquids other than water that are liquefied gases mounted on tankers (LPG)

9. To standardise the technical procedures throughout the national territory for the periodic inspection of the instruments referred to in the technical data sheets reported. This directive adds 2 new sheets to those already defined by Decree 93/2017 and is framed in a context which aims to homogenise the activities of the bodies carrying out periodic inspection and to improve the effectiveness of controls by the competent authorities, in order to strengthen consumer confidence and to guarantee trade.

10. References to basic texts: - Decree No 93 of the Minister for Economic Development of 21 April 2017: corresponding to notification 2016-580-I.
- It should also be noted that the European information procedure relating to the draft directive of the Minister for Economic Development, concerning also the adoption of technical data sheets for the periodic inspection of in-service measuring instruments used for legal measuring purposes, was carried out with notification 2021-0178-I, supplementing the technical data sheets already defined by the above-mentioned Decree; the mandatory period of abstention from adoption of the measure ended on 24 June 2021 and no comments were received from the Member States, and the related measure is being adopted.

15. The content of the Decree is consistent and aligned with the provisions of Ministerial Decree 93/2017; therefore, the Decree is not expected to have a significant impact on operators in the relevant sectors and on the holders of the metric instruments in question.
