5. Draft Act amending certain acts in order to prevent usury (UD286)
6. The draft Act will affect money-lending services supplied by electronic means, i.e. it may generate an increased interest in and popularity of loans granted in relations between interested individuals without the use of a financial institution as an intermediary, including via special web portals. It should be noted that the draft Act may, in practice, have legal impact on money-lending services supplied by electronic means.

8. The draft Act on amending certain laws in order to prevent usury (UD286), in so far as it includes notifiable provisions, provides for supplementing the existing national legislation to combat usury.
The draft Act is subject to notification to the European Commission as it contains technical provisions within the meaning of Directive (EU) 2015/1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical regulations and of rules on Information Society services. The draft Act will affect money-lending services supplied by electronic means, i.e. it may generate an increased interest in and popularity of loans granted in relations between interested individuals without the use of a financial institution as an intermediary, including via special web portals. It should be noted that the draft Act may, in practice, have legal impact on money-lending services supplied by electronic means.
9. The draft Act contains technical provisions within the meaning of Directive 2015/1535 and must therefore be notified to the European Commission. It should be emphasized that failure to notify the European Commission would have serious ramifications for Poland and would include the legal inadmissibility of Polish administrative bodies and courts to apply the provisions of the future Act. The previous draft Act amending certain laws in order to prevent usury (UD286) was notified to the European Commission on 28 June 2019 under document number 2019/313/PL.
