As a core element, the draft Ordinance provides for an obligation to use a functional barrier in the production / placing on the market of food contact materials and articles (FCM) made of waste paper. This is to prevent the transfer of mineral oil aromatic hydrocarbons (MOAH) in order to take consumer health protection into account in this regard. Certain possibilities for exemption from the barrier obligation are provided for. The FCM in question can also be manufactured / placed on the market without a functional barrier if the food business operator who uses the FCM explicitly declares a corresponding waiver to the manufacturer or the entity placing the FCM on the market. In these cases, the food business operator must take suitable measures/requirements to ensure that the MOAH transfer is below the provided detection limit. If, moreover, the manufacturer/distributor of the FCM can take other measures/requirements to ensure that no MOAH are transferred from the FCM in question to food, the barrier obligation also does not apply.
The detection limit for demonstrating that MOAH transfer does not take place is 0.5 mg MOAH / kg of food for a transfer to the food. If corresponding tests are instead carried out with food simulants and not in food, a detection limit of 0.15 mg MOAH / kg of food simulant is used. This is due to the fact that in a food simulant, the mineral oil analysis can be carried out much more precisely due to the lower amount of interference factors.

Food can be contaminated with mineral oil, as has been shown, among other things, by studies within the framework of a research project funded by the Federal Ministry of Food and Agriculture (Extent of migration of undesirable substances from packaging materials made of waste paper to food - Extra report on the analysis of ‘119 foods’ on undesirable substances from waste paper, funding code 2809HS012). In addition to other sources of entry, a major cause of this is also FCM made of paper, paperboard or cardboard, especially when made of recycled paper / waste paper.
Mineral oil is obtained from petroleum and is a complex mixture, which mainly consists of saturated (chain and ring-shaped) and aromatic (mostly alkylated) hydrocarbons. In some cases, considerable amounts of mineral oil hydrocarbons have been found in food. This also includes MOAH in particular. The Federal Institute for Risk Assessment is of the opinion that the absorption of MOAH should be minimised as it cannot be ruled out that MOAH contain substances which may cause health damage, e.g. cancer, even in the smallest quantities. The European Food Safety Authority (EFSA) also raised concerns in its opinion of 3 May 2012 (EFSA Journal 2012;10 (6):2704) with regard to exposure to MOAH due to the possible carcinogenic potential.
In order to protect consumers from possible health risks, the Ordinance is intended to regulate a substantial part of the various MOAH sources of entry and thus limit the transfer of MOAH to food from FCM made of paper, paperboard and cardboard made of/with waste paper material as much as possible. At the same time, this safety measure is intended to preserve the possibility of using waste paper materials / recycled paper in the FCM area.
