Regulation (EC) No 852/2004 on the hygiene of foodstuffs: Article 13(3) to (7)
Pursuant to Article 13 of Regulation (EC) 852/2004, without prejudice to the objectives of the Regulation in question, the Ordinance lays down national measures for the adaptation to the requirements set out in Annex II, concerning the use of traditional methods, operations in approved business establishments dealing with food of animal origin situated in regions that are subject to special geographical constraints, and enabling the implementation of adaptation measures for small-scale establishments regarding the construction, layout and equipment of establishments.
Regulation (EC) No 853/2004 on the hygiene of foodstuffs: Article 10(3) to (7)
Pursuant to Article 10 of Regulation (EC) 853/2004, without prejudice to the objectives of the Regulation in question, the Ordinance lays down national measures for the adaptation to the requirements set out in Annex III, concerning the use of traditional methods, operations in approved business establishments dealing with food of animal origin situated in regions that are subject to special geographical constraints, and enabling the implementation of adaptation measures for small-scale establishments regarding the construction, layout and equipment of establishments.
Commission Implementing Regulation (EU) 2019/627 laying down uniform practical arrangements for the performance of official controls on products of animal origin intended for human consumption in accordance with Regulation (EU) 2017/625: Article 13
With entry into force of new EU regulations on official controls, specifically Article 13 of Commission Implementing Regulation (EU) 2019/627, the Ordinance implements derogations from the time frame for post-mortem inspection.
In addition, pursuant to Article 13(3) of Commission Implementing Regulation (EU) 2019/627, the Ordinance defines a ‘livestock unit’ for different species and categories of animals based on the conversion coefficients set out in Article 17(6) of Regulation (EZ) No 1099/2009.
Pursuant to Article 15 of Commission Implementing Regulation (EU) 2019/627, the Ordinance applies a derogation regarding the requirements for post-mortem inspection of bovine animals over eight months old and domestic swine more than five weeks old.

In order to adapt to the requirements laid down in EU regulations on food of animal origin, the Ordinance establishes measures prescribing specific requirements regarding the construction, design, and equipment of establishments operating with food of animal origin that are subject to approval, and enables approved small-capacity establishments to continue to use the traditional methods at each stage of production, processing, or distribution of food of animal origin, and facilitates business operations in regions that are subject to special geographical constraints.

The same regulation, the Ordinance on measures for the adaptation to the requirements of regulations concerning food of animal origin, is in force and implemented since 2015 and has been amended twice. The original text and the amendment from 2019 were notified to the EC under the notification numbers: 2014/454/HR and 2018/322/HR.
This regulation enables business operators to adapt to the requirements of regulations concerning food of animal origin in terms of infrastructure, equipment and production procedures for small-scale establishments.
The motive for the adoption of the new Ordinance is the entry into force of the new EU regulations on official controls, namely Commission Regulation (EU) 2019/627, which, compared to the current Ordinance, provides additional opportunities for adaptation to the requirements concerning food of animal origin related to increasing the slaughter capacity of poultry and postponement of post-mortem inspection at the slaughter line of ungulates and poultry in small-capacity establishments. In addition, with the amendment of national legislation and the entry into force of the new Act on food hygiene and microbiological criteria for foodstuffs (Official Gazette, No 83/22), the basis for the adoption of the Ordinance has changed.
Consequently, the new version of the Ordinance further opens up opportunities for food business operators operating in small-capacity establishments to adapt to the requirements of regulations concerning food of animal origin, defines more clearly the conditions for performing certain activities in small-capacity establishments, all without prejudice to food safety and hygiene, and the protection of consumer health.
