5. Ordinance of the Salzburg State Government amending the Ordinance laying down Guidelines for the Structural Design and Layout of Hospitals
6. Structural design and layout of hospitals, in particular with regard to the size and equipment of treatment and care facilities, treatment devices, sanitary facilities and patient transport devices

Pursuant to Article 7(6) of the Salzburg Hospitals Act 2000 (SKAG), the State Government may, taking into account the findings of medical and technical sciences and after consulting the State Health Council, issue guidelines for the structural design and layout of hospitals, in particular with regard to the size and equipment of treatment and care facilities, treatment devices, sanitary facilities, patient transport devices and the provision of suitable shelter areas against risks arising from war, as well as with regard to the necessary measures to ensure the proper operation of the hospital.
9. Re point 3: Article 2 regulates general space requirements in hospitals. The possibility of dispensing with individual rooms or merging functions, as previously provided for in Paragraph 2, is to be moved to a separate Paragraph 5 in order to express clearly that this also applies to independent outpatient clinics (points 3.1 and 3.3). Here it is added that provisions on worker protection may also preclude a combination of different space requirements. In Paragraph 4(3) (point 3.2), the term ‘waiting room’ is replaced with ‘reception/waiting area’, since areas are in practice often not set up as separate waiting rooms. Furthermore, in point 4 of Paragraph 4, a clarification is made to the effect that the toilet facility for patients is to be provided in addition to that for staff.
Re point 4: As with other workplaces, hospitals are subject to extensive and detailed federal requirements (cf. the Workplaces Ordinance (RIS) – Workplaces Ordinance (Arbeitsstättenverordnung) Article 0 – consolidated federal law). Additional provisions should therefore be issued only where this is necessary because of the specific requirements in hospitals. Thus, with regard to the requirements for room heights and volumes (Articles 23 and 24 of the Workplaces Ordinance), special provision is made to the effect that patients are to be regarded as employees.
In addition, point 4.2 provides for the mandatory installation of insect screens on openable windows. This protective measure was previously included as a requirement in the decision for company authorisation under hospital law, and is now included in the text of the Ordinance.
Re point 5: Common toilets for staff and non-staff are not possible according to the requirements of worker protection, so the exemption previously provided for independent outpatient clinics in Article 6(1) of the Ordinance is obsolete and may be dropped. For systematic reasons, the equipment of wheelchair-accessible toilet facilities, which was until now provided for in Paragraph 2, has been moved to a separate Paragraph 3 and supplemented with a reference to the relevant accessibility standard (ÖNORMEN für accessible construction). The inner width of 80 cm previously required in paragraph 2 for doors in toilet installations intended for patients is deleted, as this will follow from Article 8(2) of the Ordinance in future. Paragraph 4 of the proposed text corresponds unchanged to the former Article 6(3).
Re point 6: The special provisions for self-employed outpatient clinics previously contained in Article 8(3) are deleted and, overall, the rules on the necessary ranges of doors and passageways are simplified and adapted to the needs of practice. The required inner door width of 120 cm for areas with bed traffic is still derived from the ÖNORM inventory for accessible construction in healthcare facilities (ÖNORMEN for accessible construction) and the previously required 225 cm for corridors with bed traffic remains. These minimum widths apply in all cases where bed traffic takes place in hospitals, i.e. also for independent outpatient clinics with bed traffic.
In future, it will be possible to deviate from these minimum widths in independent outpatient clinics without bed traffic and in hospitals with beds in areas where no bed traffic occurs (and no bed traffic is to take place In future). The minimum inner door width without bed traffic is 90 cm, and is to be adapted to OIB Guideline 4 2019 to increase comfort when walking through or passing with a wheelchair or walker. However, this can be reduced to 80 cm in exceptional cases, provided that patients are not adversely affected by this and no disability is expected in patient traffic.
