The Ordinance essentially brings the Inland Waterways Code into force as a police regulation on the German Danube, while at the same time repealing the Danube Navigation Police Regulations that have been in force there to date. A separate chapter has been introduced in the Inland Waterways Code for the Danube-specific provisions. Furthermore, arrangements for the Main and Main-Danube Canal that have been in place temporarily are incorporated into permanent law by means of the Ordinance. These include requirements for the passage of vessels and passenger ships exceeding 110 m in length upstream of the port of Aschaffenburg. In addition, provisions on navigation lights for vessels have been extended, clarified or simplified, and rules of navigation adapted.
References to the current Danube Navigation Police Regulations contained in further inland shipping provisions have also been deleted.
9. The Danube Navigation Police Regulations that are being repealed date back to 1993. New Basic Rules of Navigation on the Danube (Dispositions fondamentales relatives à la navigation sur la Danube, DFND for short), adopted in the meantime by the Danube Commission which is responsible for the Danube in its capacity as international river commission, have not been implemented in Germany.
The requirements for lights, draught marks, draught scales, signal lamps and radar devices are fundamentally laid down in § 1.01(30) and (31), § 2.04, § 3.02(2) and § 4.06(1) first sentence letter a in the general part of the Inland Waterways Code and refer to the relevant EU regulations in this regard. When it comes to the technical requirements for lights, draught marks, draught scales, signal lamps and radar systems as well as to their affixation, the current Danube Navigation Police Regulations, on the other hand, refer to the regulations of the competent authorities. The more recent DFND, which has not been implemented in Germany, in turn refers in this respect to the recommendations of the Danube Commission on technical provisions for inland waterway vessels. Situations can therefore occur where lights, signal lamps or radar devices currently used on the Danube or the affixation of draught marks and draught scales do not fully comply with the requirements of the Inland Waterways Code and therefore with the technical directives for inland waterways adopted by the European Commission. The provision in § 28.30 stipulates that lights, signal lamps and radar devices that can be used on the basis of the current 1993 Danube Navigation Police Regulations may continue to be used in the future, and draught marks and draught scales may remain affixed until they are replaced.
The need for further amendments to the Inland Waterways Code has arisen
from daily practice.
Adapting other shipping law provisions to the abolition of the Danube Navigation Police Regulations is a logical measure that is necessary in the interest of legal clarity.
