5. Draft Ordinance introducing electronic legal correspondence and electronic file management at the Federal Office of Justice (BfJ) in financial penalty enforcement procedures under the German-Swiss Police Treaty (CHGeldERAV)

6. Electronic documents must be furnished with an electronic signature. The use of electronic legal correspondence is optional.

8. The draft ordinance is to establish the legal basis for the introduction of electronic legal correspondence and electronic files at the BfJ in financial penalty enforcement procedures under the German-Swiss Police Treaty.

The draft ordinance provides that it will be possible to submit documents to the BfJ electronically in the future and imposes requirements with respect to the signature of electronic documents. In addition, electronic file management at the BfJ is being enabled.

The draft ordinance does not, however, obligate the original penalty-imposing German authorities or private parties involved in the procedures to submit documents electronically to the BfJ (as there is no corresponding legal basis for this in German law).

With the entry into force of the German-Swiss Police Treaty, correspondence with Switzerland for the purposes of assisting in the enforcement of traffic fines is placed on a statutory footing for the first time. The aim is, as far as possible from the outset, to handle such enforcement assistance correspondence under Chapter VI of the German-Swiss Police Treaty electronically and to maintain electronic files.

Given the projected number of cases, a paper-dominated procedure would be too time-consuming and costly. The storage of paper files entails high costs for the BfJ. The introduction of electronic legal correspondence and electronic file management is intended to relieve the workload for the BfJ and other German and Swiss authorities and courts involved in the enforcement assistance procedure. It will allow for modern and efficient procedures. It is also intended to provide citizens, businesses and legal representatives with a modern form of communication, the use of which is optional.
