5. Title: Decree of the Ministry of Transport of the Slovak Republic amending Decree of the Ministry of Transport and Construction of the Slovak Republic No 139/2018 laying down the details on originality checks, as amended
6. Product/Service details: Originality checks of road vehicles
7. Notification under another EU act:
8. Summary: The aim of the present draft Decree is to supplement the provisions governing the training of originality check technicians. The draft amendment to Act No 106/2018 on the operation of vehicles in road traffic and on amendments to certain acts, as amended, and amending certain acts (parliamentary print no 1326) allows originality check technicians to undertake continuous training while their certificates remain valid, as an alternative to the current form of training. In view of the above, a system of continuous training is introduced with regard to the professional competence of originality check technicians, and provisions are laid down on the organisation, delivery, assessment and record-keeping of continuous training.
The draft Decree also responds to needs arising in practice, in particular with regard to expanding the scope of the data submitted to the register of vehicle operating records. The aim is to ensure that information systems, originality check stations and entities providing data to the register of vehicle operating records function effectively in practice.
9. Brief statement of reasons: The aim of the draft Decree amending Decree No 139/2018 is to improve and expand the data maintained in the register of vehicle operating records, to increase the transparency of vehicle history, to strengthen consumer protection and road safety, and to make originality checks more effective.
The proposed legislation extends the scope of the data recorded, in particular to include information relating to odometer readings, vehicle repairs and damage, damage incidents and vehicle financing. At the same time, a system of continuous training of originality check technicians is introduced, the requirements for technical and diagnostic equipment of stations are updated, the security of electronic data exchange is enhanced and provision is made for access to electronic certificates of conformity.
9a. Suitability of the measure for attaining the objective pursued: The proposed legislation is an appropriate means of attaining the objectives pursued, since it responds directly to the needs identified in practice in the field of vehicle originality checks and the maintenance of the register of vehicle operating records.
The expansion of the scope of the data recorded and changes relating to their provision will contribute to increasing the transparency and reliability of information on vehicle history, thereby strengthening consumer protection and road safety. The introduction of continuous training for originality check technicians will allow their professional knowledge and skills to be regularly updated. The modernisation of the technical equipment of stations and the strengthening of the security of electronic communications will contribute to increasing the quality, efficiency and credibility of the checks carried out.
The proposed measures are proportionate to their purpose and create the conditions for effectively attaining the objectives pursued, taking into account technological developments, needs arising in practice and requirements for the proper functioning of information systems in the field of originality checks.
9b. Necessity: The proposed legislation is essential to ensure the effective functioning of the vehicle originality check system and the register of vehicle operating records, as well as to bring the implementing legislation into line with forthcoming legislative changes and the needs of practice.
The existing legislation does not sufficiently reflect technological developments in the field of vehicle diagnostics, the increasing requirements for record-keeping and data exchange, or the need for continuous improvement of the professional competence of originality check technicians. Attaining the objectives pursued therefore requires adjustments to the scope of the data recorded, the conditions under which they are provided, the system of professional training and the technical requirements for originality check stations.
The proposed measures constitute the necessary legislative framework to attain the objectives pursued, building on the existing system for originality checks and updating it without the need to create new administrative structures. The chosen method of regulation makes it possible to respond to identified deficiencies and ensure uniform application of the requirements in practice.
9c. Excessive burden in relation to the objective pursued: The proposed legislation does not impose a disproportionate burden in relation to the objectives pursued, which are to increase the transparency of data on vehicles, strengthen consumer protection and road safety, and improve the performance of originality checks.
While the proposed measures may place certain administrative, technical and organisational demands on the entities concerned, particularly in connection with the expansion of the scope of the data provided, the modernisation of stations' technical equipment and the introduction of continuous training for technicians, these demands are justified by the expected benefits of the legislation.
The draft also takes into account the need to minimise the burden on the entities concerned, in particular by utilising existing information systems, introducing continuous training as an alternative to the current form of training, and establishing a transitional period to allow for the adaptation of stations’ technical equipment.
The expected benefits of the proposed measures for road safety, consumer protection and the reliability of originality checks outweigh the related obligations of the entities concerned. The draft legislation therefore does not impose an excessive burden in relation to the public interest it seeks to serve.
