5. Order requiring economic operators to provide consumers with clear and complete information on foods that are or contain species of any insect authorised to be placed on the market as novel foods
6. The Order sets out the arrangements for informing consumers regarding food information that is/contains species of any insects authorised to be placed on the market as novel foods in accordance with Commission Implementing Regulations (EC) 2021/882, 2021/1975, 2023/5 and 58/2023, namely yellow mealworm, Locusta migratoria, house cricket and Alphitobius diaperinus larvae (lesser mealworm) as well as any other insect species included in the Union’s list of novel foods in the Annex to Implementing Regulation (EU) 2017/2470, marketed both in the conventional direct sales areas and by means of a remote communication technique, as well as finished food products / food prepared and / or offered for sale to the consumer for consumption on the spot or at home by mass caterers.
7. - Regulation (EU) No 1169/2011 on the provision of food information to consumers: articles 40, 43, 44 and 45
- When drawing up the Order, the following Community normative acts were also taken into account:
- Regulation No 2283/2015 on novel foods, amending Regulation (EU) No 1169/2011 of the European Parliament and of the Council and repealing Regulation (EC) No 258/97 of the European Parliament and of the Council and Commission Regulation (EC) No 1852/2001,
- Commission Implementing Regulation (EU) 2017/2470 of 20 December 2017 establishing the Union list of novel foods in accordance with Regulation (EU) 2015/2283 of the European Parliament and of the Council on novel foods,
- Commission Implementing Regulation (EU) 2021/882 of 1 June 2021 authorising the placing on the market of dried Tenebrio molitor larva as a novel food under Regulation (EU) 2015/2283 of the European Parliament and of the Council, and amending Commission Implementing Regulation (EU) 2017/2470,
- Commission Implementing Regulation (EU) 2021/1975 of 12 November 2021 authorising the placing on the market of frozen, dried and powder forms of Locusta migratoria as a novel food under Regulation (EU) 2015/2283 of the European Parliament and of the Council and amending Commission Implementing Regulation (EU) 2017/2470,
- Commission Implementing Regulation (EU) 2023/5 of 3 January 2023 authorising the placing on the market of Acheta domesticus (house cricket) partially defatted powder as a novel food and amending Implementing Regulation (EU) 2017/2470,
- Commission Implementing Regulation 58/2023 authorising the placing on the market of the frozen, paste, dried and powder forms of Alphitobius diaperinus larvae (lesser mealworm) as a novel food and amending Implementing Regulation (EU) 2017/2470.
8. The draft legislative act ensures that consumers in Romania are better informed with regard to food information that is / contains species of any insects authorised to be placed on the market as novel foods in accordance with Commission Implementing Regulations (EC) 2021/882, 2021/1975, 2023/5 and 58/2023, namely yellow mealworm, Locusta migratoria, house cricket and Alphitobius diaperinus larvae (lesser mealworm) as well as any other insect species included in the Union’s list of novel foods in the Annex to Implementing Regulation (EU) 2017/2470, marketed both in the conventional direct sales areas and by means of a remote communication technique, as well as finished food products/food prepared and/or offered for sale to the consumer for consumption on the spot or at home by mass caterers, information intended to help consumers make informed choices.
The Order requires economic operators to:
- in the case of marketing in conventional direct sales areas, indicate the information on foodstuffs which are / contain insect species authorised to be placed on the market as novel foods and be presented in a separate stand, delimited by stands containing established products which are not/do not contain insect species authorised to be placed on the market as novel foods. The display of the required information shall be carried out by the economic operator, on a support or panel, in a colour contrasting to the background colour of the panel, according to the model shown in the Annex to the Order, on a monocoloured support or panel, without gradient fill or other graphical or colour markings, visibly and in an unequivocal, easily readable form with Times New Roman font - font size 20;
- in the case of marketing by means of a remote communication technique, indicate the information on food that is / contains insect species authorised to be placed on the market as novel foods in such a way that the information is available and accessible before the order is completed, on the remote selling medium, on the price label or transport packaging and in any advertising material;
- in the case of marketing of the finished product / food supplied by mass caterers, which is / contains insect species authorised to be placed on the market as novel foods, the information shall be made available and accessible directly at the place of sale / supply of this product / food or, in the case of marketing by means of a remote communication technique, before the order is completed. The information must be entered in a visible, easily accessible, legible, indelible place and must not be hidden by other written or photographic material, next to the product, on a panel / menu; If the finished products / foods supplied by the mass caterers are offered for sale at several different places within the same unit, this information shall be presented to the consumer at each of these places.
9. As a result of the information published in the public space, including on social networks, it was found that most Romanian citizens are reluctant to consume food products that are / contain species of any insects authorised to be placed on the market as novel foods. At the same time, experience has shown the need for regulation through rules requiring economic operators to indicate, in a clear, precise and unequivocal manner, information about the nature of food products. Given that food products that are / contain species of any insects authorised to be placed on the market are novel foods, with which consumers are not familiar, they shall be presented in separate stands from those with classic and duly marked food products.
The need for regulation by this Order is also required by the fact that all consumers must be able to distinguish and differentiate foods that are / contain species from any insects authorised to be placed on the market as novel foods from traditional foods consumed over time.
For the same reasons it was considered necessary to inform consumers also in the case of marketing by means of a remote communication technique for foodstuffs which are / contain insect species authorised to be placed on the market as novel foods in such a way that the information is available and accessible prior to the completion of the order and in the case of marketing of the finished product / food supplied by the mass caterers, which are / contain insect species authorised to be placed on the market as novel foods, so that the information is available and accessible directly at the place of sale / supply of this product / food or, in the case of marketing by means of a remote communication technique, before the order is completed.
The Order shall require to provide consumers with essential information about the nature of the food products to be purchased for consumption.
Taking into account the issues raised and taking into account the powers of the National Authority for Consumer Protection for surveillance and control, as well as correct, complete and precise information to consumers regarding the nature and characteristics of the food purchased, it was considered necessary to adopt this national legislative act.
