In general, with regard to the amendments made by Royal Decree 306/2020 of 11 February 2020, Royal Decree 637/2021 of 27 July 2021 and Royal Decree 1053/2022 of 27 December 2022 in relation to training, it is clarified that this requirement also applies to the farm owner provided they work in contact with animals, and the qualifications that may be valid for the purposes of complying with this obligation are made more flexible.
It has also been considered relevant to reformulate the use of the terms ‘manure’, ‘solid manure’ and ‘slurry’ in order to increase the precision of the rules.
Similarly, in order to ensure precision and consistency, the regulatory references for the reporting of emission-reduction techniques and the time references for national emission limits have been revised.
And, with regard to emissions, it specifies the relationship between the annual report produced by the Ministry of Farming, Fisheries and Food on the implementation of Best Available Techniques and their progress in each of the livestock sectors, and the report compiled using data on trends in pollutant gas emissions from the Spanish Emission Inventory System (SEI), which will be submitted to the Livestock Sector Management Board established by Royal Decree 306/2020 of 11 February 2020.
9. In the course of the practical implementation of the original texts of the aforementioned royal decrees, as well as subsequent amendments, a number of elements have been identified for which it has been deemed appropriate to make corrections. These are mainly minor errors or certain elements of the text that may give rise to ambiguities. It has also been considered appropriate to include very specific changes in some technical requirements of the texts of the aforementioned royal decrees. This Royal Decree is therefore being published with the aim of rectifying these issues, thereby enhancing regulatory clarity, precision and consistency, as well as facilitating the interpretation and application of the rules by the sectors concerned and the competent authorities.
9a. The aim of the measure is to amend three basic rules governing livestock holdings in order to avoid duplication and ambiguity and to enhance the clarity and precision of the rules, thereby facilitating their interpretation and application by the sector and the competent authorities, as well as ensuring their consistency with existing EU and national legislation.
Since the entry into force of the rules and in the course of their implementation, both the sector and public administrations have identified the need to amend some requirements that gave rise to problems in their implementation. For this reason, and given that regular coordination meetings have been held with all stakeholders throughout the years these regulations have been in force, it is considered essential to implement these amendments; consequently, the publication of these regulations to amend the original rules is the appropriate course of action.
This measure brings greater consistency to the rules, thereby enhancing their effectiveness.
9b. These rules focus on providing clearer definitions of certain terms used in the text to ensure greater consistency. They do not impose any significant restrictions on the existing regulations, which are specific rules that include additional requirements to those set out in the general regulations, in order to ensure the harmonised development of the livestock sector in our country.
They do not affect cross-border trade or services, as they merely set out requirements that livestock holdings in our country must meet.
Throughout the implementation of the three management rules, efforts have been made to address the shortcomings and lack of precision identified through interpretative notes or various agreements with the competent authorities, but it has become apparent that an official regulatory amendment is required to ensure legal certainty for operators.
Generally speaking, the measures contained in these rules aim to relax certain requirements and are therefore no more restrictive than the existing rules.
9c. Given that the amendments introduced by these rules do not substantially alter the content or objectives of the rules currently in force, as they do not entail a fundamental reform of the current livestock management rules, they do not impose any additional restrictions nor interfere in any way with the internal market.
Nor do they disadvantage operators; rather, the aim is to provide greater legal certainty and consistency in the regulations.
