8. The attached draft decree is issued on the basis of Articles L. 1271-2 to L. 1271-5 of the Transport Code. These articles provide for the creation of a single national file of identified bicycles as well as an obligation for traders to sell bicycles with a unique identifier. This obligation comes into force on 1 January 2021 for new bicycles and on 1 July 2021 for second-hand bicycles.
The draft decree specifies the obligation imposed on traders and on professionals involved in destruction activities or preparation for the recovery or reuse of bicycles. It also sets out the conditions for approval by the State of legal persons capable of implementing bicycle identification systems.

9. Need to adopt the draft regulatory provisions:
The draft decree is issued in accordance with Article L. 1271-5 of the Transport Code.
The intention of the government is to encourage the practice of cycling, and to triple its modal share in travel. The objective of the measure is to combat theft, which is one of the main obstacles recognised to the practice of cycling. The Ministry of the Interior estimates that around 300 000 households are affected by theft each year. After a theft, victims tend not to buy a bicycle or go down market, so they buy less secure equipment. More expensive electric bicycles are increasingly targeted. Today, only 7% of households that have had their bicycles stolen recover them.
To effectively combat the theft, concealment and illicit sale of bicycles, modelled on a similar scheme in Denmark, it is necessary to create a compulsory system for identifying bicycles and electrically assisted bicycles associated with an owners’ file. This unique bicycle identification file will make it possible to contact the owner when the police or a lost and found service recovers an identified bicycle. In addition, when exchanging a second-hand bicycle between individuals, the buyer can check whether the bicycle has been declared stolen.
The obligation placed on traders to identify bicycles during sale allows them to reach a critical mass and create an effective scheme. The identification of bicycles on a voluntary basis, in place in France since 2004, has not made it possible to set up a sufficiently generalised system. A few hundred thousand bicycles have been labelled for a fleet of around 30 million bicycles. With the new obligation, around 1.5 million bicycles will be identified each year.

Proportionality of the draft legislative provisions
The regulatory provision is proportionate insofar as the obligation on traders is based on two less restrictive and inexpensive actions: affixing an identifier on the frame of the bicycle (as a general rule by micro-engraving or by affixing a sticker) and entering the bicycle identifier, its owner and the means of contacting its owner in the database.
It is therefore sufficient for the trader to associate upstream with one or more approved identification operators which on the one hand offer a technical process for affixing an identifier and on the other manage a database of bicycles and their owners. The databases set up by approved operators shall feed into the single bicycle identification file.

Non-discriminatory nature of the draft regulatory provisions
The regulatory provision is not discriminatory, insofar as the obligation relates to traders and not to bicycle manufacturers. In addition, bicycles not sold in France and those already in service are not affected by the identification obligation. The owners of these bicycles will however be invited to identify their bicycle to benefit from the associated advantage.
