6. Introduction of a so-called cancellation button

8. Article 1(5) (§ 312k BGB-E [draft German Civil Code]) is being notified. The provision provides for the introduction of a so-called cancellation button. The obligation applies to the company who is the contractual partner of the consumer. This company must ensure that the consumer fundamentally has the ability to cancel their continuing obligation contract by means of a cancellation button on a website when such a contract can be concluded on a website. The provision contains detailed specifications with respect to the actual design of the cancellation button, the establishment of a website for confirming cancellation by the consumer, and confirmation of receipt of the cancellation declared by the company concerned. If the company fails to fulfil their obligation, then the consumer retains a special right to terminate. The regulation does not apply to financial services.

9. In comparison to the generally uncomplicated ability to conclude a contract in electronic commerce, the cancellation of such a contract often poses particular challenges for consumers. The cancellation of continuing obligation contracts concluded in electronic commerce should therefore be facilitated for consumers.
