8. Licence holders must ensure that only persons aged over 18 participate in betting. To that end, a betting customer card is required at betting terminals in case of doubt. Furthermore, a betting customer card is required for any bet where the value of the stake exceeds EUR 70. Pursuant to this amendment, customers can also be identified using biometric recognition procedures.

Moreover, in order to safeguard betting customers, bets where the value of the stake exceeds EUR 500 and live bets (excluding bets placed on a (numerical) interim or final result or an event deriving therefrom, or on which individual or team will next improve their standing) are prohibited.

The draft Act has already been notified (2017/208/A), but given that significant amendments have been made to the text during the legislative process, a new notification will now be submitted, this time at the final committee report stage. The introduction of additional circumstances in which bets are prohibited in order to safeguard betting customers should be regarded as a significant change. In this context, bets where the value of the stake exceeds EUR 500 and live bets (excluding bets placed on a (numerical) interim or final result or an event deriving therefrom, or on which individual or team will next improve their standing) are prohibited.

Otherwise, the following statements from the first notification shall apply:

The new opportunities opened up by technical progress must be taken into account by creating prerequisites for the requisite identity checks during subsequent visits (i.e. after the initial obligatory identification involving the presentation of an official photo ID) without the customer having to personally present official photo identification, provided the identity check at least ensures equivalent levels of identification in terms of its legitimising effect when biometric recognition procedures are used. An optional biometric recognition procedure that has been consulted on must be designed so as to ensure secure and unambiguous identification (such as with fingerprints). In general, this will ensure a higher degree of security in terms of customer identification during subsequent visits than can be achieved by identification and presentation of the betting customer card (eliminating handling costs for checks as well as the possibilities that the card may be misused if the card is transferred or lost). This will protect young people and betting customers as well as take account of the prevention of use for the purpose of money laundering and the financing of terrorism.

The same shall also apply to the betting sector.
