8. The draft Decree relating to on-demand audiovisual media services implements the Order transposing Directive (EU) 2018/1808 of the European Parliament and of the Council of 14 November 2018 amending Directive 2010/13/EU (‘audiovisual media services’).
It repeals the Decree in force, No 2010-1379 of 12 November 2010 relating to on-demand audiovisual media services implementing Directive 2010/13/EU in its version prior to the amendment made by Directive (EU) 2018/1808.
Its purpose is to subject foreign on-demand audiovisual media services targeting French territory to the contribution scheme for the production of cinematographic and audiovisual works, which currently applies only to French ODAVMS publishers. The publishers in question will be able to conclude an agreement with the French Higher Audiovisual Council (CSA) specifying these obligations.
On this occasion, the draft Decree also changes the rules applicable to all ODAVMS (introduction of service agreements with the CSA, thresholds for triggering obligations based on audience and turnover, adaptation of contribution rates, amendment of independent production criteria, etc.).
These rules are applicable to French and foreign ODAVMS in a uniform manner. However, agreement with the CSA is not compulsory for foreign ODAVMS.

The French authorities wished to implement the option offered by Article 13.2 of the revised AVMS Directive in order to ensure the sustainability of our system of financing the production of works, in particular of an independent nature, and to guarantee equity between French publishers and global platforms.
Subjecting foreign ODAVMS targeting France to the production contribution scheme makes it possible to consolidate the financing of cinematographic and audiovisual creation at a time when changes in uses and the market are weakening the current support system, with the turnover achieved in France by operators installed in another Member State impacting, in whole or in part, that of French operators and consequently their contribution to the system.
Three production contribution schemes are planned:
- the scheme for catch-up television services, identical to that of the television service from which the catch-up service originates;
- the ODAVMS by subscription scheme, which is set by comparison with that of television services mainly offering works, including two rates depending on whether the service offers recent films or not;
- the scheme of other ODAVMS (pay-per-view or free of charge services).
