8. Article 13 of the Act on protecting farmers’ incomes and the draft decree for its implementation are intended to strengthen consumer information on the origin of unprocessed or processed cocoa for certain cocoa products. To this end, the draft decree provides for an obligation to indicate the name of the country of origin of the cocoa for the following products, when packaged in France: cocoa powder, fat-reduced cocoa powder, chocolate powder and sweetened chocolate powder and equivalent names, chocolate, milk chocolate, sweetened milk chocolate, filled chocolate and chocolate candy.
9. There is a proven link between certain properties of chocolate and its origin. The natural and wild cocoa tree grows in Africa and South America. Nowadays, it is cultivated on all continents. Cocoa beans are the seeds of cocoa trees that make chocolate. The quality of the cocoa bean depends on the conditions of its cultivation: the soil where it is grown and the climate. Chocolate will not have the same taste, depending on the origin of cocoa trees, its pods and therefore its beans.
A recent study carried out by the Bureau for Societal Analysis for Citizen Information (BASIC) on behalf of the European Commission, the European Cocoa Association (ECA) and the FAO analysed the impact of the decision applied by the Ivory Coast and Ghana to increase the selling price of a tonne of cocoa, which had been frozen for several years. These price movements are known to French consumers who are very attentive to a fair remuneration of producers and consequently to the origin of the foodstuffs and in particular chocolates which are placed on the market.
