8. This draft decree introduces a threefold amendment to Decree No. 2021-793 of 22 June 2021 on on-demand audiovisual media services (SMAD Decree), as regards the contribution to the production of audiovisual works.
It first adjusts the so-called "diversity" obligation, already existing in the decree, within the overall contribution to audiovisual production. The Decree now provides that this diversity is ensured by genre of works under conditions determined by the agreement concluded between the service publisher and the regulator, without, however, providing a minimum proportion of this obligation or specifying the type of expenditure taken into account. First, the draft decree sets the share of expenditure devoted to animation, creative documentary and recordings or recreations of live shows at a minimum of 20% of the contribution to the production of audiovisual works, after a three-year increase, leaving publishers free to choose the minority genre(s) concerned according to their editorial line. Secondly, the draft provides that a minimum share of the sums devoted to each of these three genres must finance new works, according to the parameters already provided for the share of the overall contribution devoted to pre-financing, namely for publishers with a net annual turnover of more than EUR 50 million and up to 75%.
Finally, the draft decree extends to animated audiovisual works the regime already applicable to cinematographic works as regards the taking into account of rights acquired for foreign territories. Thus, in case of acquisition of rights for exploitation abroad, expenses are taken into account within the limit of 75% of the total amount invested.

In the first place, as regards the diversity obligation, the study on the implementation of the SMAD decree carried out by the National Centre for Cinema and the Moving Image and the Regulatory Authority for Audiovisual and Digital Communication and published in November 2024 reveals that this obligation, the objective of which is to ensure a minimum volume of funding for minority genres, has not been followed up in its current state. According to this study, works of fiction account for almost 90% of funding by SMAD publishers, compared to 9% for animated works and 1% for creative documentary works. The study notes, on the other hand, that the expenditure on animation relates mainly to acquisitions of programmes already funded and broadcast by television service publishers, these reaching more than 90% of the total expenditure on animation in 2023.
Thus, the contribution of SMAD does not sufficiently benefit the production of new works in terms of other genres than fiction, in particular animation. The animation sector is also facing important challenges already identified by the European Commission in the context of the priorities of the MEDIA programme: shifting audiences to video-sharing platforms, weakening broadcasters in the face of the latter and, recently, a substantial drop in the number of international orders, with direct consequences for production companies and employment in the sector.
Secondly, as regards the inclusion of rights acquired for exploitation abroad in the statement of obligations, animation has traditionally been the first genre to be exported, with the biggest international successes being independent works whose exploitation mandates are controlled by producers (see Raynaud report of November 2024 on the balances of the audiovisual and film industry at a time of major video-on-demand platforms). The aim of this measure is therefore to restore the ability of producers to monetise the dissemination of their works in non-platform territories, while effectively contributing to their circulation in Europe and worldwide.
