5. Draft Government Act amending Act No 321/2004 on viticulture and wine production and on amendments to certain related acts (the Viticulture and Wine Production Act), as amended

Act No 321/2004 on viticulture and wine production and on amendments to certain related acts is being amended in order to adapt the legal code of the Czech Republic to new, directly applicable and immediately applicable European Union Directives. It is also being amended as part of combating various black markets for wine.

9. The reason for amending Act No 321/2004 on viticulture and wine production and on amendments to certain related acts is to adapt the Czech law to new, directly applicable and immediately applicable European Union Directives, especially:
1) Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007, as amended.
2) Commission Delegated Regulation (EU) 2015/560 of 15 December 2014 supplementing Regulation (EU) No 1308/2013 of the European Parliament and of the Council as regards the scheme of authorisations for vine plantings; and
3) Commission Implementing Regulation (EU) 2015/561 of 7 April 2015 laying down rules for the application of Regulation (EU) No 1308/2013 of the European Parliament and of the Council as regards the scheme of authorisations for vine plantings.
In addition, as part of combating various black markets for wine, a number of measures are being proposed, the aim of which is to increase consumer protection and reduce the ability to mislead the consumer, eliminate avoidance of requirements and obligations stipulated by law, and to increase sanctions for non-compliance.
