5. Royal Decree governing national commercial designations and designations of preserved and prepared food permitted in Spain applicable to fishery and aquaculture products.
6. Fishery and aquaculture products admitted on the List of commercial designations, including fishery and aquaculture products preserved or prepared, in accordance with points (a), (b), (c), (e), (h) and (i) of Annex I to Regulation (EU) No 1379/2013 on the common organisation of the markets in fishery and aquaculture products
7. - The Royal Decree refers to Regulation (EU) No 1379/2013 of 11 December establishing the common organisation of the markets in fishery and aquaculture products.
The national trade names admitted in Spain listed in points (a), (b), (c) and (e) of Annex I to Regulation (EU) No 1379/2013 are established for the purpose of providing the mandatory information set out in Article 35 thereof.
The names of preserved or prepared foods listed in points (h) and (i) of Annex I to Regulation (EU) No 1379/2013 are also laid down for the purpose of providing the mandatory information laid down in Article 17 of Regulation (EU) No 1169/2011.
8. The content of the Royal Decree first reflects its subject-matter, followed by the definitions contained in the European and national regulations on fisheries, and the definitions set out in Articles 3 and 4 of Royal Decree 1521/1984 of 1 August approving the Technical-Health Regulations for Establishments and Products of Fisheries and Aquaculture with Destination for Human Consumption are applicable.
The Royal Decree also lays down the precondition for the sale of fishery and aquaculture products to end consumers or to groups, details the annual review of the list of national commercial designations permitted in Spain and of designations of preserved and prepared foods applicable to fishery and aquaculture products, and details the procedure to be adopted for reviewing and updating the list.
It also lays down the procedure to be adopted for administrative cooperation between the central State administration and the relevant bodies in the Autonomous Communities, as well as the penalty system under Law 3/2001 of 26 March.
It lays down the single market clause, together with the use of alternative names for the species Sardina Pilchardus, Trachurus spp., Auxis rochei, Auxhis thazard, Merluccius spp. and Macruronus spp., in addition to providing for a period of 12 months from the entry into force of the Royal Decree to comply with the new rules for stocks of canned or prepared products and containers labelled until stocks are exhausted, together with a period of six months to adapt to a possible publication of a decision recognising a new name of canned or prepared food.
Finally, the repealed and amended regulations are detailed. Annex IV to Royal Decree 1521/1984 of 1 August, together with Article 2 of the Order of 15 October 1985 approving the Quality Standard for preserved mussels, clams and cockles, and Article 2 of the Order of 15 October 1985 approving the Quality Standard for cooked and frozen mussels are repealed.
Royal Decree 1521/1984 is amended, in particular Article 3 (Forms for the presentation, conservation and marketing of fishery and aquaculture products) and Article 4 (Parts of fishery products).
Finally, the Royal Decree lays down the attribution of powers, the authority for the Ministry of Agriculture, Fisheries and Food to issue detailed regulations and, as an Annex, the list of national commercial designations permitted in Spain and the designations of preserved and prepared foods applicable to fishery and aquaculture products.
9. The aim of the standard is to adapt the current national legislation to scientific changes, new consumption trends and habits and the current commercial climate, as well as to the existing European Union legislation on food information to consumers and common marketing standards for specific products (as with some of the more sought-after fish species among end consumers such as tuna, bonito, sardines and sardine-type products).
In addition, it aims to establish and simplify, including in a single regulatory body, both the national trade names, as well as the names of canned foods or preparations accepted in Spain, applicable to fishery and aquaculture products.
On the other hand, taking into account the scope and content of the standard, a procedure is introduced for the revision and updating of the list of national trade names and canned food names and preparations applicable to fishery and aquaculture products.
Since the previous notification (2020/0582/E), the project has undergone a number of changes that recommend repeating the procedure. In particular, there have been changes affecting some names contained in the Annex, as well as improvements in the wording of the text of the standard and some specifications.
