8. This notification refers to the Gambling Regulation Bill 2022. This Bill provides for the establishment and functions of a body to be known as Údarás Rialála Cearrbhachais na hÉireann (the Gambling Regulatory Authority of Ireland) which is to be responsible for licensing and regulating gambling in Ireland, including the regulation of betting, gaming, certain lotteries and the sale or supply of products or services related to gambling. The Bill also provides for the imposition of obligations on licensees and other persons, including obligations relating to advertising, promotion and sponsorship for the purposes of safeguarding persons participating in gambling, and monitoring and enforcing compliance with obligations imposed on licensees. The Bill has commenced its passage through the Houses of the Oireachtas (Parliament of Ireland); it passed Second Stage in Dáil Éireann on 02 December 2022. The Bill remains subject to amendment until it has completed all stages of the parliamentary process. It is envisaged that, subject to the agreement of both Houses of the Oireachtas and subject to this notification process, the Bill will enter into national law in Ireland in late 2023 or early 2024.
9. This notification is to notify the entire Bill. However, we wish to draw particular attention to the following draft provisions which we have identified as likely to be pertinent within the terms of the Technical Standards Directive.
Section 70 Prohibition on purchase of gambling product or gambling related service from unlicensed person
Section 97 Assessment of suitability of premises
Section 138 Advertising on on-demand audio-visual media services and other electronic means of communication
Section 139 Prohibited material in advertisement
Section 140 Information to be included in advertisement
Section 142 Prohibition on branded clothing and merchandise
Section 166 Protection of children
In addition, sections 125, 126, 130, 131, 133 and 134 of the Bill concern conditions attached to various types of licence. If/when any of these conditions are intended to be imposed on licensees that offer their products or services on a remote basis, then these conditions would have to be notified under the TRIS procedure by Údarás Rialála Cearrbhachais na hÉireann (the Gambling Regulatory Authority of Ireland).

Furthermore, with regard to section 151 (Promotion: relevant gambling activities) which provides that the Minister for Justice may make regulations regarding the restriction or prohibition of the promotion of certain gambling activities, we note that this section (and the related draft regulations) would also have to be specifically notified under the TRIS procedure if/when the Minister intends to make such regulations.
Regarding section 118 (Power to set standards for certain gambling products and gambling related services) and the related section 119 (Application for certification of gambling product or gambling related service where standards in effect in accordance with section 118), it is noted that notification will be required under the TRIS procedure in the future when Údarás Rialála Cearrbhachais na hÉireann (the Gambling Regulatory Authority of Ireland) intends to set any such standards. At this stage, however, we wish to point out that we intend to propose an amendment to the Bill so that standards published under section 118 in respect of software used for the operation of gambling shall come into effect six months after the date of such publication (a reduction from the three year period provided in the current Bill) as this would better reflect the fast pace of software development; consequential amendments will be made to the Bill in respect of this change.
Regarding Section 138 (Advertising on on-demand audio-visual media services and other electronic means of communication), we intend to propose an amendment to the Bill to update a number of definitions to ensure consistency with recent legislation.
