- Grounds for the adoption of the Decree pursuant to Article 39 of Regulation (EU) No 1169/2011
The draft Decree of the Minister of Agriculture (AM) amending Ministry of Agriculture (FM) Decree No 36/2014 of 17 December 2014 on food information (hereinafter referred to as: Draft) lays down that based on Commission Implementing Regulation (EU) 2017/2470 of 20 December 2017 establishing the Union list of novel foods in accordance with Regulation (EU) 2015/2283 of the European Parliament and of the Council on novel foods the name of foodstuffs containing, in any form, insects or their larvae which have been authorised as novel food (hereinafter: foodstuff containing insect protein) must be accompanied by an indication in a font size that is at least the same as the font size used for the name of the product, reading ‘Attention! Food contains insect protein’.
Article 39 of Regulation (EU) No 1169/2011 of the European Parliament and of the Council of 25 October 2011 on the provision of food information to consumers, amending Regulations (EC) No 1924/2006 and (EC) No 1925/2006 of the European Parliament and of the Council, and repealing Commission Directive 87/250/EEC, Council Directive 90/496/EEC, Commission Directive 1999/10/EC, Directive 2000/13/EC of the European Parliament and of the Council, Commission Directives 2002/67/EC and 2008/5/EC and Commission Regulation (EC) No 608/2004 (hereinafter: Regulation (EU) No 1169/2011) states in connection with the establishment of mandatory national requirements for the labelling of foodstuffs that:
‘(1) In addition to the mandatory particulars referred to in Article 9(1) and in Article 10, Member States may, in accordance with the procedure laid down in Article 45, adopt measures requiring additional mandatory particulars for specific types or categories of foods, justified on grounds of at least one of the following:
(a) the protection of public health;
(b) the protection of consumers;
(c) the prevention of fraud;
(d) the protection of industrial and commercial property rights, indications of provenance, registered designations of origin and the prevention of unfair competition.’
In view of the above, Hungary informs the Commission that the Draft will be adopted on the grounds set out in Article 39(1)(a) and (b) of Regulation (EU) No 1169/2011 for the protection of public health and the protection of consumers, as detailed below (annex other text).
8. The amendment of Ministry of Agriculture (FM) Decree No 36/2014 of 17 December 2014 on food information provides that the name of any foodstuff which contains insect protein must be accompanied by an indication in a font size that is at least the same as the font size used for the name of the product, reading ‘Attention! Food contains insect protein’. Furthermore, in order to ensure a clear distinction, marketed foodstuffs containing insect protein should be placed separately on the shelves for customers.
The amendment also lays down provisions for the use of non-prepacked and catering products containing insect protein, as well as for the use of non-compliant packaging and labels and for the keeping on the market of products bearing such packaging or labels.
9. Pursuant to Regulation (EU) 2015/2283 of the European Parliament and of the Council of 25 November 2015 on novel foods, only novel foods authorised and included in the Union list may be placed on the market in the European Union. Recently, the European Commission has authorised a number of novel foods that allow insects or their larvae to be used in food.
According to Regulation (EU) No 1169/2011 on the provision of food information to consumers, food information should be accurate, clear and easily understood by consumers. Regulation (EU) No 1169/2011 also provides that ingredients must be indicated on foodstuff, and in connection with this Commission Implementing Regulations authorising novel foods in the European Union specify the names under which the authorised ingredients should be indicated.
In addition to the above requirements, the amendment of Ministry of Agriculture (FM) Decree No 36/2014 of 17 December 2014 on food information stipulates that the name of the food containing insect protein must be accompanied by the following indication in a font size at least equal to the font size used for the name of the product: ‘Attention! Food contains insect protein’. Furthermore, in order to ensure a clear distinction, marketed foodstuffs containing insect protein should be placed separately on the shelves for customers.
