8. The Ordinance amending the Ordinance relating to fruit jams, jellies, marmalades, preserves and sweetened chestnut purée amends the Ordinance relating to fruit jams, jellies, marmalades, preserves and sweetened chestnut purée (Official Gazette No 84/19) as follows:
The requirement regarding the minimum quantity of fruit to be used in the manufacture of jams and jellies is increased in order to reduce the amount of sugar used in the manufacturing of the products.
In connection with the above, the use of reserved names as defined in Annex I is authorised for products which have a soluble dry matter content of less than 60 %, but meet the conditions applying to the nutrition claim ‘reduced sugars’ laid down in the Annex to Regulation (EC) No 1924/2006.
Furthermore, since Directive 2024/1438 introduces the possibility of using the term ‘marmalade’ for jams not obtained from citrus fruit, in order to harmonise the regulations with the terms commonly used by consumers in Member States, the name for citrus products is changed to ‘citrus marmalade’ in order to clearly distinguish the two categories. In connection with the above, since the Republic of Croatia has not used the option of using the alternative term, a new provision on the labelling of the aforementioned product as ‘citrus marmalade manufactured from three or more fruits’ is also added.
Annex II is also amended by introducing the possibility of adding concentrated juice as an acidifying agent in all categories of jams and jellies.
Also, regarding the use of food additives, since this is already regulated by Regulation (EC) No 1333/2008, certain provisions of Annex III to Directive 2001/113/EC are deleted, and Annex II is adapted.
9. The Ordinance relating to fruit jams, jellies, marmalades, preserves and sweetened chestnut purée (OG No 84/19) lays down the quality requirements that must be met in the production and marketing of jam, extra jam, jellies, extra jellies, marmalades, jelly marmalade, preserves and sweetened chestnut purée as regards the names, definitions and general requirements, composition and sensory properties, the type and quantity of raw materials and other substances used in the production and processing, as wells as additional labelling requirements.
This Ordinance transposes into the legal framework of the Republic of Croatia provisions of Council Directive (EU) 2001/113/EC of 20 December 2001 relating to fruit jams, jellies and marmalades and sweetened chestnut purée intended for human consumption (OJ L 10, 12. 1. 2002).
Directive (EU) 2024/1438 of the European Parliament and of the Council amending Council Directives 2001/110/EC relating to honey, 2001/112/EC relating to fruit juices and certain similar products intended for human consumption, 2001/113/EC relating to fruit jams, jellies and marmalades and sweetened chestnut purée intended for human consumption, and 2001/114/EC relating to certain partly or wholly dehydrated preserved milk for human consumption was adopted on 14 May 2024 (as part of the so-called Breakfast Directives). In order to transpose the provisions of the aforementioned Directive into the legal framework of the Republic of Croatia, draft Ordinance amending the Ordinance relating to fruit jams, jellies, marmalades, preserves and sweetened chestnut purée is hereby adopted.
