8. In accordance with the underlying EU law, the present Ordinance aims to create the national legal basis for the voluntary labelling of foods with the Nutri-Score label.
Nutri-Score is a label for extended nutrition labelling. A five-point scale from A to E shows an overall value for a product’s nutritional value. For this purpose, the calorie count and various nutritional values are offset against each other.
Nutri-Score is a Community collective mark registered with the European Union Intellectual Property Office. The mark proprietor is the French Agence nationale de la santé publique (or Santé publique France for short). It has established conditions of use for the use of the mark, which also includes registration.
In its opening clause, the draft Ordinance creates the legal framework for food labelling for the approval of voluntary use of the Nutri-Score label in Germany.
The already applicable trade mark regulations remain unaffected. For clarification, the draft Ordinance indicates that the use of the mark in Germany particularly necessitates that the consent required under trade mark law be obtained and that the conditions of use of the trade mark proprietor be observed.
Publications of German versions of the relevant French documents are intended to simplify participation in the system, particularly for small and medium-sized enterprises. The publications serve as an aid; the language versions of the mark proprietor, which are particularly relevant under trade mark law, remain legally binding.

9. Germany has decided to further develop nutritional labelling for Germany as part of its healthy nutrition policy. Simplified nutrition labelling intends to make the healthy choice an easy choice for consumers. Consumers should be able to receive information about the nutritional properties of a food in a simple and understandable manner.
Comprehensive studies have examined questions surrounding both nutrition as well as consumer understanding and perception. In its preliminary report on the description and assessment of selected front-of-pack nutritional labelling models, the Max Rubner-Institut, Federal Research Institute of Nutrition and Food, determined that Nutri-Score is founded on a nutritionally valid framework (https://www.bmel.de/SharedDocs/Downloads/Ernaehrung/Kennzeichnung/MRI-Bericht-Naehrwertkennzeichnungs-Modelle.pdf?__blob=publicationFile). In a consumer research study, Info-GmbH came to the conclusion that, in comparison to the models examined, Nutri-Score is the best perceived and understood (https://www.bmel.de/SharedDocs/Downloads/Ernaehrung/Kennzeichnung/Ergebnisbericht-Repr%C3%A4sentativerhebung-TeilA_eNWK.pdf?__blob=publicationFile). The process was accompanied by consultation with representatives from the economic, consumer representative and healthcare sectors.
In using the green and light green colour, Nutri-Score is, according to widespread legal opinion, a nutrition claim in accordance with Article 2(2)(4) of Regulation (EC) No 1924/2006 on nutrition and health claims made on foods. In the absence of European approval, the use of Nutri-Score in Germany that takes this view into account requires a regulation that has undergone the notification procedure in accordance with Article 23 of Regulation (EC) No 1924/2006.
Studies have shown that the food composition table is too complex for certain groups of people. The draft Ordinance was drawn up taking into account the provisions of Regulation (EU) No 1169/2011 on the provision of food information to consumers.
