8. Article 7a of Directive 2018/1808 on audiovisual media services empowers Member States to take measures to ensure the appropriate visibility of services of general interest (SGI). Seizing this opportunity, Order No 2020-1642 of 21 December 2020 transposing Directive 2018/1808 introduced into Law No 86-1067 of 30 September 1986 a new Article 20-7.
This article makes operators who determine the arrangements for the presentation of audiovisual communication services on user interfaces subject to the obligation to ensure, in the French territory, the appropriate visibility of all or part of the SGI and the identification of the publishers of these services, in accordance with the conditions specified by ARCOM. It refers to a decree the task of setting the threshold for defining the providers of the “user interfaces” actually targeted and specifying the deadlines for the implementation of the obligations set by ARCOM.
The draft of this decree is the subject of this notification. It cancels and replaces a first draft notified to the Commission under reference No 2022/63/F, which had been the subject of requests for additional information from the Commission, to which the French authorities replied on 29 March. Indeed, since the notification of the project in February, the French authorities have continued their exchanges with the stakeholders and have become aware of new data which led them to adopt a single amendment set out in the succinct statement of reasons.
The initial draft had been the subject of a public consultation between October and November 2021. The Decree sets a first threshold applicable to interfaces provided natively on devices and a second threshold applicable online services and application stores.
It also sets the time limit for the application of the obligations from the date of publication by ARCOM of the list of operators subject to them and specifies the procedures for the first application.

The new data brought to the attention of the French authorities led them to adopt a single amendment, namely to revise the first threshold, initially set at 200,000 user interfaces marketed or made available as part of an offer of audiovisual communication services in the last calendar year in France, to reduce it to 150,000 interfaces. This reduction in the threshold is intended to achieve the objective of capturing the main players in the markets for connected TVs, connected speakers and so-called “IPTV” offers provided by Internet service providers.
The second threshold is set at an average of 3 million unique visitors per month located in France in the last calendar year. It provides an insight into the main distributors of over-the-top television services and the main application stores.
Starting from the annual publication by ARCOM of the list of operators who must comply with the obligations to put forward, they shall have a period of 6 months to implement these obligations.
